Интересно, что в немецком Основном Законе закреплено право граждан на восстание - п.4 ст. 20, "когда другие средства борьбы с теми, кто пытается сломать устройство федеративной республики, исчерпаны".

Насколько я понимаю, тоже право закреплено и в американском законодательстве

Да. Когда запрещали KPD в 1959-м по-моему, она пыталась аппелировать к этому праву.

ну, поскольку KPD саму запрещали именно за то, что в программе у нее был указан слом устройства федеративной республики, то такой подход вряд ли мог быть эффективным.

Интересно отличие от американских формулировок (в конституции самих США этого нет, но в конституция многих штатов и декларации независимости есть):

That whenever any Form of Government becomes destructive of these Ends, it is in the Right of the People to alter or abolish it, and to institute a new Government, laying its Foundation on such Principles, and organizing its Powers in such Form, as to them shall seem most likely to effect their Safety and Happines

Из той же статьи формуровка, типичная для конституций штатов - That government being instituted for the common benefit, the doctrine of non-resistance against arbitrary power and oppression is absurd, slavish, and destructive of the good and happiness of mankind

PS: Отличие состоит в том, что в немецком случае целью восстания предполагается охрана самой государственной конструкции "от слома", а у американцев - наоборот - слом государственной конструкции, переставшей отвечать базовым требованиям.
